The current form constitutes a brief unraveling of concepts, object and the procedural applicability of two procedural institutions which are everyday confused, misused and misunderstood by both professional lawyers who excercise freely they career and justice managers; being the aim of this paper to clarify as much as possible what it concerns to each one of them and fundamentally its particular procedural application.
To achieve the established objective, it shall be proceeded to quote and analyze the concepts given by jurists as well as the regulatory limits of each one of them by means of the bibliographic analysis with the occasional support of hermeneutics, for which I have considered necessary to divide this succinct paper into three sections: 1) Fundamental concepts. 2) Object and application 3) Conclusions and recommendations.
