The present paper accomplishes a documentary and critical analysis of the constitutional precedent in Ecuador and its configuration in the new Constitution of 2008; Evidencing certain inconveniences of interpretation and highlighting importance and degree of importance of the present as the amendment to the articles of incorporation’s motor and the dialectic construction of history, without brushing aside the judge like subject of her same, for which will be able to come across constant arguments that the authors in this theme, without stopping to criticize the status sell off quo in use.
