Abstract

Article 427 of the Peruvian Penal Code penalizes the crime of document falsification. This paper examines this offense in detail, from its basic concepts to the configuration of its objective type and its implications. Furthermore, we are interested in defining the legal right protected, its connection to traffic safety, and its classification as a dangerous crime within criminal law. A qualitative approach of the applied type and a grounded theory design were used. The different interpretations of vehicle license plates will be analyzed, as well as how their falsification lacks regulations specifying its considerations, in order to determine whether they merit a criminal sanction and whether legal proceedings would be necessary for crimes against public trust, representing a violation of road safety in the national transportation system.
